Krista Millea was not in the limousine when the crash occurred, but is a plaintiff because she has a related "loss of services" lawsuit stemming from the crash. In a statement issued Saturday, Wal-Mart reiterated that it was "cooperating fully" in the ongoing investigation. Truck driver Kevin Roper, 35, of Jonesboro, Georgia, pleaded not guilty to death by auto and assault by auto charges. The former "30 Rock" star suffered a broken leg and broken ribs when the limousine van he was riding in was hit from behind June 7 by a Wal-Mart truck on the New Jersey Turnpike. The wreck killed 62-year-old comedian James McNair, a Peekskill resident who went by the name Jimmy Mack. Comedian Ardley Fuqua and another passenger, Jeffrey Millea, were injured. On Thursday, lawyers for Morgan filed a lawsuit against Bentonville, Ar kansas-based Wal-Mart Stores Inc. in U.S.

District Court in New Jersey, claiming the retailer was negligent when a driver of one of its tractor-trailers rammed into Morgan's limousine van. The complaint claims the retail giant should have known that its driver had been awake for over 24 hours and that his commute of 700 miles from his home in Georgia to work in Delaware was "unreasonable." It also alleges the driver fell asleep at the wheel. Morgan's suit seeks a jury trial and punitive and compensatory damages. Fuqua, Jeffrey Millea and Millea's Associated Press TRENTON, N.J. SHUART, ROBERT W. Teacher tenure fight gaining momentum Robert W. Shuart of Suffern, NY passed away July 8, 2014 at the age of 86. Born January 29, 1 926 to Harry and Mary Shuart in Suffern. Bob went to school in Suffern and then joined the Army and fought in the Asiatic-Pacific theatre, he was discharged in 1946.

Bob married Beatrice Smith in 1951 and had two children, Leo and Patricia-Ann. He was predeceased by his parents, siblings, wife, and his daughter. He is survived by his son Leo and daughter-in-law Lori and granddaughter Heidi Lynn Goetz and two great-granddaughters Miranda, and Payton. Bob was retired from the Bear Mountain State Police, and was a life member and Ex Chief 41 of the Suffern Fire Department, Ramapo Valley Ambulance, life member of the American Legion in Suffern, Rockland and Orange County Fire Police, worked for Avon and then the Village of Suffern. He was also Honorary Fireman for Stover Volunteer Fire Department.

He was a member of the Ramapo Masonic Chapter 32nd degree Mason and past patron of the Eastern Star. LANZILOTTI AGE: 58 ERIE, PA Mother Maureen of the Precious Blood, O.C.D. (Janice M. Lanzilotti), 58, of the Carmelite Monastery of Erie, PA, returned home to God on Thursday, June 26, 2014. She was born August 8, 1955 in Plainfield, NJ. Mother Maureen earned her bachelor's degree in music, a master's degree in business administration, and her Juris Doctor degree.

On January 8, 2000, Mother Maureen entered Carmel. Sister's First Profession was on December 8, 2003, followed by her Profession of Solemn Vows on December 12, 2006. She was later named Prioress of the Carmel of the Holy Family on October 7, 2013. She is survived by her devoted parents, Anthony and Maureen (Haney) Lanzilotti of Pearl River, NY; two brothers, Dr. Thomas Lanzilotti (Jean Marie) and Michael (Jean) Lanzilotti; a sister, Karen (Paul) Lappin and many nieces and nephews.

She is predeceased by her husband Theodore Seebach in 2013. She is survived by her son, John and wife Laurie Seebach of Warwck, NJ; daughter, Barbara Perino and husband Christopher of Martinsville; grandchildren, Gregory Yahm and wife Brandy and John Michael Seebach; 2 great-grandchildren, Ayden Yahm and Kelsey Yahm. Even in his early 80s he continued to work at Koblin's Pharmacy in Nyack, NY.

Flea markets and antiquing brought Alvin great pleasure, and he enjoyed both holding and attending garage sales. He loved the camaraderie that surrounded them. Alvin had a strong sense of family, and he loved a good story. Alvin married Sandra Burns in 1960 and has two children, Janet L. Burns (Lome Wolfe) and Martin C.

Burns (Kimberly Olson), who survive him. He also leaves behind grandchildren Laura Burns and Weston Burns, three nieces, and two nephews. He enjoyed the last 3 years living at Capital Lakes near his son and grandchildren in Madison, Wisconsin. He was preceded in death by his parents, brothers Jerome, Jack, and Howard; sisters Sylvia Radwin and Frances Berg; and nephew Mark Radwin. And in the next few weeks, another group, the Partnership for Educational Justice, founded by former CNN newswoman Campbell Brown, says it will file an anti-tenure lawsuit in New York. And parent activists in Connecticut and Pennsylvania say they are in the early stages of preparing similar lawsuits. Gwen Samuel, president of the Connecticut parents union, said 200,000 children are stuck in low-performing schools. "Teacher tenure doesn't ensure that those kids have an effective teacher," Samuel said.

"Guaranteeing a person a job regardless of their performance is irresponsible," she said. But some say tenure rules are a small part of the reason some children have better teachers than others, also citing such factors as overcrowded schools, relatively low pay and chaotic working conditions. "There are at least half a dozen strong reasons why we may not have as highly qualified a teacher force as we might like," said Michael Rebell, a Columbia University Teachers College professor and the executive director of the Campaign for Educational Equity. Rebell said the tenure system could be improved but it's a small factor that "certainly doesn't rise to the level of a constitutional violation." Even some who agree with the California lawsuit question whether the courts are the right arena. "The intention here is entirely admirable," said Rick Hess of the American Enterprise Institute, a conservative think tank.

"I don't think the results are likely to turn out in a way that's going to actually promote reform." He added, "It's not clear what exactly constitutes an acceptable teacher tenure standard. Associated Press A month after a California judge ruled that job protections for teachers violated children's constitutional rights, one lawsuit making the same claim has been filed in New York, another has been announced and critics of teacher tenure in other states say they are preparing litigation as well.

The June ruling in California has been stayed pending appeal and may never take effect, but critics of tenure are seizing on the idea of using the courts to try to improve schools. Mona Davids, president of the parents group that filed the New York lawsuit targeting teacher tenure last week, called educational inequity "a crisis of epic proportions." She said New York City neighborhoods that are mostly black and Latino have the schools with the highest concentration of teachers rated unsatisfactory. "Yet," Davids said, "every attempt to hold teachers accountable for educating our children is blocked." The California ruling struck down state laws dictating how long it takes for a teacher to earn tenure as well as rules that protect senior teachers during layoffs. The plaintiffs argued that such union-backed job protections mean that poor and minority schools are staffed disproportionately by bad teachers, which violates students' rights. Randi Weingarten, president of the American Federation of Teachers, said such lawsuits "mean a continuation of the artificial division that in order for students to win, teachers must lose."
